Families suing xAI over Grok-made sexual images of children seek one court for 26 cases, as a new investigation maps the litigation
Families who allege that xAI's Grok turned real photographs of their children into sexual images are asking for their cases to be heard together. On October 2 a minor plaintiff asked the U.S. Judicial Panel on Multidistrict Litigation to transfer 26 federal actions involving Grok and other generative AI tools to the Western District of Arkansas for coordinated pretrial proceedings, before Chief Judge Timothy L. Brooks. The request decides only where the cases are heard, not whether the allegations are true; all of the claims remain allegations.
The Arkansas cases at the centre of the filings involve a children's photographer whom police arrested after a search reportedly found about 1,700 sexual images and videos of children, some allegedly created with Grok from ordinary school and family portraits. Six Arkansas children are plaintiffs in a proposed nationwide class action, filed by Beasley Allen, which alleges xAI failed to use safeguards other developers use and kept selling access to the image features. The filings cite research by the Center for Countering Digital Hate estimating Grok produced about three million sexualised images in eleven days around the new year, about 23,000 of them appearing to show children.
An investigation published October 24 by Crust News pulls the threads together: it reports that xAI has sued the photographer, sought to move the families' cases to a court in Texas, and argued the images are not its responsibility as the tool's maker. xAI's public response to reporters asking about the January images at the time was 'Legacy Media Lies,' and Elon Musk posted on January 14 that he was 'not aware of any naked underage images generated by Grok. Literally zero.' The coordination panel has not yet ruled on the transfer request.
